A: The fees that CPT charges for local counsel legal services can be tailored to meet the needs of each case. The type and amount of our fee on a local counsel engagement depends on the level of involvement of our attorneys, the type of matter, and the complexity of the issues involved. The fees that CPT charges for local counsel legal services range from hourly billing payable on a monthly basis, flat-fee arrangements based on specific services, to contingency-fee and hybrid contingency-fee engagements. Depending on the specific fee arrangement, clients may be responsible for payment of incurred court costs and other litigation expenses. In addition, depending on the fee arrangement and the scope of local counsel legal services required, CPT may require an initial retainer.
Q: Are you engaged by the client, the referring attorney, or both?
A: Because the attorney-client relationship and our ethical duties are directly with the client, we typically enter into engagements with the client, which are agreed to and approved by the client's referring attorney. Depending on the requirements and needs of the client and referring attorney, we structure billing and litigation contact through the client, through the referring attorney, or both.
